Compliance, i.e. adherence to legal requirements and rules, plays an important role for the long-term success of a company. In recruiting in particular, the handling of personal data is part of our daily work and is regulated through the DSGVO.

However, compliance is an important topic especially regarding the cooperation between companies and self-employed knowledge workers. Many organizations fear the legal risks of working with freelancers. To provide the best possible protection, Aristo Group checks important parameters regarding false self-employment and covert employee leasing throughout the entire recruiting process. The experience gained from previous projects and the close cooperation within the framework of compliance management provides an important basis for successful risk minimization and protection of the company’s long-term existence. Our consultants and compliance experts are available to our clients and candidates at any time and support a secure process flow and a legally compliant cooperation during the project.

Compliance During the Recruiting Process

1. Examination of the Individual Project
Before starting the recruiting process, we check the feasibility of your request regarding the cooperation with a freelancer. The service provided within the scope of the project must be clearly defined and distinguishable from the company’s day-to-day business. The independent knowledge worker must not be integrated into the company's infrastructure for the entire duration of the project.
2. Qualification of Candidates Using Our Compliance Check
We qualify candidates before we introduce them to our clients. When working on a freelance basis, we also perform a compliance check to verify some key data that is decisive when hiring a freelancer.
3. Accompaniment of the Interview Process
During the interview stage, we not only accompany you on a professional level but also advise you on the agreements and arrangements as well as the possibilities for cooperation in your individual project. The goal is to clearly identify possible risks and to present approaches on how to contain them.
4. Contract Execution and Service Description
The Aristo Group also supports you regarding the preparation of the service description, which provides the contractual basis for the cooperation between you, the independent expert, and the Aristo Group. This description will also be thoroughly checked regarding important framework parameters and is binding for the future process.
5. Support During the Project
During the project we stay in close contact with you as well as the freelancer. On the one hand we want to ensure the success of the project, on the other hand we want to be able to recognize possible risk factors. Thus, we accompany you even after the conclusion of the contract regarding false self-employment and covert employee leasing and check the compliance with the measures taken beforehand to minimize any risks.

The Aristo Compliance Check

An important step in our compliance management process is our Aristo Compliance Check, which we conduct with all freelance candidates during their qualification process. The Compliance Check is conducted through self-disclosure using a questionnaire and a scoring system. Only if this process has been successfully completed, we will present the candidates to our clients.

APSCO Germany (Association Professional Staffing Companies) is the German association for the recruitment industry. Members are international and domestic personnel agencies based in Germany.
