Risk Minimization through Successful Compliance Management

Compliance, i.e. adherence to legal requirements and rules, plays a decisive role in the long-term success of a company in many relevant areas. In recruiting in particular, the handling of personal data is part of daily work and is regulated by the GDPR.

However, compliance is a particularly important topic in terms of collaboration between companies and external consultants. Many organizations fear the legal risks associated with the use of freelancers, which are regulated by law. In order to provide the best possible protection, the Aristo Group checks important parameters relating to bogus self-employment and concealed temporary employment throughout the entire recruitment process. On the other hand, the experience gained from previous projects and the close cooperation within the framework of compliance management provide an important basis for successfully minimizing risk and securing the company’s long-term existence. Our consultants and compliance experts are available to our clients and candidates at all times and support not only a secure process but also compliance-compliant cooperation during the project.

Compliance throughout the Entire Recruiting Process

1. Evaluation of the Individual Project
In advance of starting the recruiting process, we review the feasibility of your request to work with a freelancer. The task to be performed as part of the project must be clearly defined, and it must be possible to distinguish it from the day-to-day business. The external consultant must not be integrated into the company's infrastructure for the entire duration of the project.
2. Candidate Research
We always qualify candidates before we introduce them to our clients. When working on a freelance basis, we also carry out a compliance check to verify a number of key data that are considered to be decisive for being a freelancer by definition.
3. Candidate Qualifications
Grundsätzlich qualifizieren wir Kandidaten bevor wir sie bei unseren Kunden vorstellig machen. Bei der Zusammenarbeit auf freiberuflicher Basis führen wir außerdem einen Compliance Check durch, um einige Eckdaten zu überprüfen, die als maßgeblich für die Beauftragung eines Freelancers angesehen werden.
4. Introducing the Candidate
We only introduce you to candidates who have successfully passed our compliance check. This means that our clients only get in touch with experts who meet all the criteria from a compliance perspective.
5. Supporting the Intervew Process
As part of the interviews with external consultants, we not only support you on a professional level but also advise you on the agreements and arrangements as well as the possibilities for cooperation in your individual project. The aim here is to clearly point out possible risks to you and to present approaches as to how you can mitigate them.
6. Fulfillment of the Contract & Service Description
The Aristo Group supports in drawing up the service description, which forms the contractual basis for the collaboration between the company, the freelancer, and the Aristo Group as contractual parties. Again, the service description is evaluated in detail concerning important framework parameters and is binding for the rest of the process.
7. Guidance throughout the Project Period
During the project, we are in direct contact with both the client and the freelancer. On the one hand, we aim to ensure the success of the project, but on the other hand, we also seek to point out possible risk factors in time. After the contract has been signed, we offer support concerning bogus self-employment and concealed temporary employment and review compliance with the measures previously taken to minimize any risks.

Our Aristo Compliance Check

An important step in our compliance management process is our Aristo Compliance Check, which we carry out with all freelance candidates during the candidate qualification process. The Compliance Check is a self-assessment using a questionnaire and a scoring system. Only when this process has been successfully completed will we introduce the candidates to our clients.
